1.    GENERAL

•          These terms and conditions(“TERMS AND CONDITIONS”) apply to the “Perform at Tomorrowland Brasil 2025” DJ competition (referred to below as the “CONTEST”).

•          The promotor of the CONTEST is WeAreOne.World BV, with registered offices at Kattendijkdok-Westkaai 12, 2000 Antwerp, Belgium and registered with the Crossroads Bank of Enterprises under number 0867.239.782 (referred to below as the “ORGANIZER”), alone or together with a partner or a third party on the ORGANIZER’s behalf.

•          By entering the CONTEST, the competition entrant (the “ENTRANT”) acknowledges having read, understood and fully accepts these TERMS AND CONDITIONS, which can be consulted on the following website https://academy.tomorrowland.com, (also referred to as the“CONTENT PAGE”) together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the ORGANIZER’s website, or communicated to the ENTRANT in any otherway(“COMPETITION INFORMATION”). Such COMPETITION INFORMATION shall prevail in the event of any inconsistency with these TERMS AND CONDITIONS.

•          ORGANIZER has the right, in its sole discretion,  to amend the CONTEST, COMPETITION INFORMATION, and/or these TERMS AND CONDITIONS from time to time and will keep the ENTRANT adequately informed.

•          The invalidity or unenforceability of any provision of these TERMS AND CONDITIONS shall not affect the validity or enforceability of any other provision. In theevent that any provision is determined to be invalid or otherwise unenforceable or illegal, these TERMS AND CONDITIONS shall otherwise remain in effect and shall beconstrued in accordance with their terms as if the invalid or illegal provisionwere not contained herein.

•          In the event that any ENTRANTd oes not, or is unable to, comply with and meet these TERMS AND CONDITIONSand/or the COMPETITION INFORMATION, ORGANIZER shall be entitled at its sole discretion to disqualify such ENTRANT, without any further liability to suchENTRANT. In these circumstances, any prize(s) won by the ENTRANT may beforfeited and ORGANIZER reserves the right to reclaim any prize(s) already distributed to the ENTRANT. Any ENTRANT must comply with any reasonable directions given to him or her by ORGANIZER with regard to the CONTEST including but not limited to any and all relevant laws, rules and applicable regulatory codes.

•          The ORGANIZER reserves the right,in any individual jurisdiction, to suspend and/or withdraw the CONTEST at anytime if he would be required to do so for legal reasons or for compellingself-regulatory reasons, without any right to compensation or concession to the entrants.

2.    ENTRANTS

•          The CONTEST is open to natural persons (regardless their nationality) with a paid online Tomorrowland Academy membership. ENTRANTS must be at least 18 years of age when entering the CONTESTor turn 18 in 2025.

•          Staff and co-workers of the ORGANIZER as well as staff and co-workers of other companies that are (directlyor indirectly) concerned with the organization of this CONTEST and those livingin the same household of each such individuals are explicitly excluded to enterthe CONTEST.  

3.    DURATION

•          The CONTEST opens August 6 2025 and closes September 19, 2025 at 23:59 (CEST / Brussles time) or any otherdate(s) as decided and communicated by ORGANIZER.  

•          Any entries received before the opening and after the closing of the CONTEST will be invalid and will not be entered into the CONTEST. The date of the entries will serve as proof.

4.    PRIZE

•          Only ONE ENTRANT shall berewarded as the winner (“the “WINNER”) of the CONTEST.

•          The WINNER shall receive thefollowing competition prize (the “PRIZE”) for him/herself):

•          A backstage “Artist” accreditation pass on October 9, 2025 (during The Gathering of Tomorrowland Brasil 2025 festival (the “FESTIVAL”)). In this regard, the WINNER agrees and accepts that his/her personal data (including but not limited to name, e-mail address and date of birth) will be gathered and might be turned over to the government for screening in case there is a legal base to do so. If the WINNER is considered by the government to be a safety hazard and/or any other threat, the ORGANIZER will inform the WINNER that the person in question cannot be permitted access to the FESTIVAL. The WINNER accepts and acknowledges that this implies that the PRIZE cannot be awarded. The ORGANIZER cannot be held liable for obtaining and using this information and data for the aforementioned purposes.

•          A slot to perform at The Gathering of Tomorrowland Brasil on October 9, 2025. The precise timeslot & stage is to be be confirmed by the ORGANIZER.

•          A technical and hospitality rider, to be priorly approved by the FESTIVAL, is provided at the stage during time of performance.

•          Accommodation and ground transport from the hotel to Tomorrowland are included in the PRIZE. Travel is not granted or included in the PRIZE.

•          All products and/or services related to the FESTIVAL other than those explicitly mentioned above, are excluded from the PRIZE.

•          The PRIZE is personal and non-transferable. It shall only be awarded to the WINNER and can only be claimed by the WINNER in accordance with the TERMS AND CONDITIONS. The PRIZE cannot be exchanged for other products, services or cash, nor can the date/timeslot be changed. The PRIZE is indivisible and can only be accepted as such.

•          The WINNER acknowledges that ORGANIZER’s general terms and conditions (as available on ORGANIZER’s website)shall apply to any tickets which are part of the PRIZE.

•          The WINNER accepts and acknowledges that certain guidelines/instructions may be given the ORGANIZER and/or his representatives with regard to performing at the FESTIVAL and WINNER undertakes to behave in a professional manner and as a“ bonus pater familias” with regard to these activities. WINNER shall in this respect always communicate and behave in a manner which is reasonably not deleterious towards the ORGANIZER, the FESTIVAL and/or the companies involved in the organizationof the CONTEST and/or the PRIZE.

5.    ENTRY

•          ENTRANTS may enter the CONTESTwhen having a paid online Tomorrowland Academy membership. ENTRANTS cannotenter the CONTEST with a free user account.

•          Participation in the CONTESTrequires ENTRANTS to submit (1) a recent DJ-mixtape (less than 3 monthsold) of minimum 30 minutes length through the CONTEST PAGE (every music genreis accepted), and (2) a personal motivational video (file size 500MB maximum)containing an explanation of why the concerned ENTRANT should win the CONTEST. 

•          Patricipation to the CONTEST is only possible via the CONTEST PAGE. In order to enter the CONTEST an internet connection is required. Any costs related to such internet connection are entirely borne by the ENTRANT. Any such costs cannot be reimbursed by the ORGANIZER.

•          In order to validly enter theCONTEST, the ENTRANT must complete the contest form on the CONTEST PAGE:

•          DJ name

•          First name, last name, date ofbirth andaddress, email address of the ENTRANT,

•          Age

•          Gender

•          Years of experience as a DJ ormusic producer

•          Motivational video

•          Social media information

•          Mix: link to DJ-mixtape (mixtapeshould be less than 3 months old)

•          Confirmation of legal age (18+)

•          Acceptance of the TERMS AND CONDITIONS, the COMPETITION INFORMATION and privacy policy.

•          By entering the CONTEST, ENTRANT warrants that all information submitted by him/her is true, current, and complete. Only fully completed entries will be considered valid and will betaken into account in the CONTEST.

•          The ENTRANT shall refrain fromsubmitting material that may be considered illegal, damaging, obscene,threatening, infringing third parties’ privacy or intellectual property ortrademark rights, politically incorrect, inciting to violence, racist, disrespectful,or in general contravening public order or common decency or for other reasonsis not suitable for publication.  The ORGANIZER reserves the right torefuse such entries at his sole discretion and without prior notification.

•          The ORGANIZER reserves the rightat its discretion and at any time to reject any entries that are incomplete,incomprehensible, incorrect, inaudible, lost, damaged in any way, made orreceived after the deadline for receiving entries has passed or which areotherwise deficient ornot in accordance with the present TERMS AND CONDITIONS.The ORGANIZER also reserves the right to reject entries that are unlawful,indecent, racist, inflammatory, defamatory or which can be considered to beotherwise harmful or offensive in any way. The ORGANIZER accepts noresponsibility for any incorrect, incomplete, late, lost or misdirected entriesincluded but not limited to entries not (or not completely) received due totechnical disruptioins or issues, network congestion, loss in service of onlineentry mechanisms, computer or technical errors or any other reason. TheORGANIZER cannot enterinto correspondence with ENTRANTs who experiencedifficulties when enteringonline. Any entries received which are in any way inbreach of these TERMS AND CONDITIONS will be void and will be disqualified fromthe CONTEST.

•          There is a limit of one entry perENTRANT. Entries received that exceed this limit will be invalid and will notbe entered into the CONTEST. Therefore only the first entry will be valid. Nomore than one PRIZE per WINNER will be awarded. Entries submitted throughagents or third parties or in bulk (i.e. more entries than a human being couldsubmit in the time available without the use of software or other devicesdesigned to make automated entries) will not be accepted.

•          In the event of any fault,mistake, misunderstanding or dispute concerning the correctness oracceptability of the entry or any answers given by ENTRANTS (if applicable), orthe operation of any part of the CONTEST, the decision of ORGANIZER shall befinal and no correspondence will be entered into.

•          ORGANIZER will not be liable toreimburse expenses incurred in making an entry in the CONTEST. Where ORGANIZERdecides in its sole discretion that an ENTRANT is eligible for a refund, thiswill be notified to relevant ENTRANT in writing. ORGANIZER reserves the rightto refuse to refund any messages where it suspects dishonest or fraudulentconduct on the sender’s part or where the ENTRANT has not complied with therules of the CONTEST.

•          Any ENTRANT who enters orattempts to enter the CONTEST in a manner, which in ORGANIZER’s determinationis contrary to these TERMS AND CONDITIONS or by its nature is unfair to otherENTRANTs may be removed from the CONTEST at ORGANIZER’s sole discretion.

6.    SELECTINGTHE WINNER

•          The WINNER shall be selected bythe ORGANIZER or as indicated in the COMPETITION INFORMATION and, if requiredby law or regulation, an independent judge or a panel including one member whois independent of the CONTEST’s promoters and intermediaries.

•          The following criteria will beconsidered for theselection of the WINNER: creativity, originality, positivity,fitness(alignment) with the Tomorrowland values of respect, love, equality,diversity, universality and unity.

•          The WINNER will be selectedwithin 10 days after the date on which the CONTEST closes and in the solediscretion of ORGANIZER. The selection of the WINNER by the ORGANIZER shall befinal and no correspondence will be entered into about the TERMS AND CONDITIONS,the COMPETITION INFORMATION, the organization, the selection of the WINNER,thePRIZE and/or the result of the CONTEST.

•          Should more prizes be claimedthan are available for any reason, a simple prize draw will take place for theavailable prize(s).

•          ORGANIZER may in its solediscretion refuse to provide a prize, or seek its recovery, in the event ofnon-entitlement under these TERMS AND CONDITIONS or an ENTRANT’s breach ofthese TERMS AND CONDITIONS, in case of fraud, dishonesty, or other inappropriateor improper conduct including but not limited to the use oftechnology whichenables an ENTRANT to evade entry requirements.

7.    CONTACTINGTHE WINNER

•          ORGANIZER will attempt to notifythe WINNER within 10 days after the date on which the CONTEST closes. TheWINNER will bec ontacted via the via the e-mail address provided by him/her atthe moment of entry through which the entry was posted. The WINNER will have aspecified fixed time period, as indicated in the notification from theORGANIZER, in which to claim his or her PRIZE. If ORGANIZER is unable to notifythe WINNER, or if the WINNER fails to respond within 5 days for acceptance ofthe PRIZE, this may result in forfeiture of the PRIZE and ORGANIZER reservesthe right to select an alternative winner being the ENTRANT who is ranked 1place below the original winner, in accordance with these TERMS AND CONDITIONS.

•          ORGANIZER shall within 30 daysfrom the date on which the WINNER is selected, inform the WINNER about thecollection of the PRIZE. Delivery restrictions may apply, as communicated byORGANIZER to the WINNER. No cash equivalent (where applicable) or alternativeprize will be given and the PRIZE is non-transferable and non-exchangeable, norcan the date/timeslot be changed. However, ORGANIZER reserves the right tochange the PRIZE due to circumstances beyond its control or to offer analternative of similar value.

8.    PRIVACY

•          By submitting his/her personaldetails, the ENTRANT agrees to ORGANIZER processing those details for the solepurpose of theCONTEST (including announcement of the WINNER) and in accordancewith ORGANIZER’s privacy policy which can be viewed at https://academy.tomorrowland.com/terms-and-conditions/privacy

•          ORGANIZER shall comply with allapplicable requirements of the General Data Protection Regulation, anysuccessor legislation or other applicable law.

 

9.    INTELLECTUALPROPERTYRIGHTS  (INCLUDING PORTRAITRIGHTS)

•          ENTRANTS warrant that they arethe copyright owners of any copyright works submitted, e.g. photographs anddrawings, and ORGANIZER’s use of such works (which ENTRANT permits) will notinfringe the rights of any third party.

•          The ENTRANT grants ORGANIZER afree, worldwide, transferable and non-exclusive right to use, reproduce anddistribute the submitted material within the framework of the CONTEST and/orany of ORGANIZER’s activities including but not limited to his/her activitiesat the FESTIVAL’s site and to use the submitted material for internal andexternal communication and marketing purposes without any limitation in time orterritory.

•          Moreover, the ORGANIZER shallhave the royalty-free right to use and distribute the submitted material inwhole or in part in any format and via all (social) media known to the public. The ORGANIZER reserves the right to adapt or arrange the submittedmaterial depending on the needs of the medium by all technical means processes,however with respect for the integrity of the ENTRANT.

•          If the ENTRANT is proclaimed asWINNER of the CONTEST, the ENTRANT also grants the ORGANIZER the free,worldwide, transferable and non-exclusive right to use, reproduce anddistribute his/her name, surname, image and voice as well as any materialcreated in the collection of the PRIZE withinthe framework of the CONTEST andfor internal and external communication and marketing purposes without anylimitation in territory, this through all media for a period of 1 month afterthe FESTIVAL.

•          The ENTRANT waives any and allright to compensation in any form whatsoever for the grant of rights asdescribed in this clause.

•          The ENTRANT shall defend and holdharmless the ORGANIZER from and against any claim from any third partyincluding a collecting rights society, with regard to the material submitted bythe ENTRANT, notwithstanding the right of ORGANIZER to refuse or withdraw thematerial at its sole discretion and without prior notice.

•          The WINNER may create content foruse on social mediaregarding the PRIZE in mutual agreement with the ORGANIZER.

10. LIABILITY

•          To the maximum extent permittedby applicable law, the ORGANIZER and third parties (directly or indirectly)involved in the organization of the CONTEST and/or the PRIZE cannot be heldresponsible for any damage of whatever nature as a consequence of the organizationof or entering into the CONTEST, the selection of the WINNER, the awarding ofthe PRIZE or the consequences of accepting the PRIZE.

•          The ORGANIZER reserves the rightto modify, revise, interrupt, cancel, postpone the CONTEST or any aspectthereof in case of Force Majeure or in general circumstances beyond control ofthe ORGANIZER, amongst others but not limited to a court decisions, withoutthis giving rise to any liability, claim and/or damages.    

•          Printing, spelling or settingfaults or technical or other problems with respect to or on the occasion of theCONTEST cannot be used to claim any kind of damages, obligation or liability onthe part of the ORGANIZER, nor can the ORGANIZER be held liable for a technicalproblem whereby the CONTEST cannot be entered, nor for technical problems thatmay impede the continuous and uninterrupted course of the CONTEST.

•          The ORGANIZER can under nocircumstances be held responsible for incorrect personal details (name,telephone number, address, e-mail address, etc.) provided by the ENTRANT,resulting in an incorrect or unknown address of the ENTRANT.

•          If (a part of) the PRIZE does notarrive on time as aresult of loss and/or delay in delivery by the postalservices, and/or the postal services damage (part of) the PRIZE deliberately orotherwise, the ORGANIZER can under no circumstances be held liable.

•          The WINNER shall be liabletowards the ORGANIZER for any and all damages caused by its actions in thecollection of the PRIZE.

11. COMMUNICATIONAND DISPUTES

•          No communication, other thanmentioned in     the present TERMS AND CONDITIONS shall take placeregarding the CONTEST,     neither by telephone nor in writing.

•          The relationship between theORGANIZER and     the ENTRANT is governed by Belgian law only. Anydisputes between the     ORGANIZER and an ENTRANT concerning theexistence, interpretation,     carrying out and consequences of thisCONTEST and the present TERMS AND     CONDITIONS, fall under theexclusive jurisdiction of the courts of Antwerp,     Belgium.

12. CANCELLATIONOFTHE FESTIVAL / FORCE MAJEURE

•          In case the PRIZE cannot beawarded due to cancellation of the FESTIVAL or Force Majeure, the ORGANIZERwill be released from its obligations towards the WINNER and will have nofurther liability towards the WINNER or ENTRANT

•          The term Force    Majeure as used in the present Terms and Conditions shall mean any cause orcauses not reasonably within the control of ORGANIZER and which, by theexercise of reasonable diligence, ORGANIZER is unable to prevent or overcome,including acts of God; strikes, lockouts or other industrial    disturbances; acts of the public enemy, acts of terror, sabotage, wars,blockades, military action, insurrections or riots; epidemics; landslides,subsidence, lightning, earthquakes, fires, storms or storm warnings; crevasses,floods or washouts; civil disturbances; explosions, inability of ORGANIZER toobtain, after the exercise of reasonable diligence, necessary materials,supplies, rights of way or permits; or any action or restraint by any governmentalauthority.

 13. GENERALTERMS AND CONDITIONS OF THE FESTIVAL

By enteringthis CONTEST, the ENTRANT explicitly acknowledges having read, understood andfully agrees to the general terms and conditions of the FESTIVAL.
